Ask the MAC

Fit to drive?

Q. We have had a query from one of the deport managers asking if there are any health or medical conditions that would stop a driver from holding an ADR certificate?

A. Although this is not covered in the ADR Agreement concerning the International Carriage of Dangerous Goods by Road, any medical exemptions would apply to the individual’s driving certificate, and by proxy, the individual then would not be able to use their ADR because they don’t have a valid driving licence. When assessing their fitness to drive, this would determine if the individual were fit to hold an ADR certificate.

The incredible bulk

Q. We have found that one of our bulk tanker vehicles MOT expires in August but the ADR1c certificate expires a month earlier. As we want the ADR1c test carried out at the time of MOT, would we be able to use the vehicle until we can have the tests carried out together?

A. Unfortunately not as Under 9.1.3.4 of ADR, the vehicle cannot be used after the expiry of the ADR1c Certificate. You would either wait for the MOT or bring the MOT forward before the vehicle can be used. If the ADR 1c test was carried out either 1 month prior or after the expiry date, then this date would be preserved.
