Ask the MAC

With Percy Thrower, Manager of Dangerous Goods Information

It's the weekend, work or rest?

Q. Can you please advise what we can do in the situation where our driver has entered the wrong manual entry for the weekend? Instead of recording it as rest, they have recorded the period as work which now shows that they were working the weekend instead of rest.

A. If for any reason the driver completes an incorrect manual entry into the tachograph (eg if the driver inadvertently makes an incorrect manual entry on a digital or smart tachograph or fails to correctly operate the mode button or switch), the driver must make a manual tachograph record to this effect. For digital or smart tachographs, the driver should make and sign a printout for the relevant period with a note giving details of the error and reason at the time the error is made. For analogue tachographs, the record should be made at the back of the chart.

Speeding? Who needs to know...

Q. Do we need to inform the Traffic Commissioner when a driver received notification to attend a speed awareness course?

A. The Office of the Traffic Commissioner’s statutory guidance on driver conduct says that there are occasions when drivers are offered awareness courses as an alternative to prosecution, conviction and endorsements. Whilst this is most common for speeding offences, it may also be offered for other offences. In the normal course of events, the Traffic Commissioner will not be aware of the offer of an awareness course, but to ensure a consistent and fair approach, they are of the belief that the attendance of an awareness course should be treated as an offence and should therefore be notified within 28 days.
