Ask the MAC

With Percy Thrower - CMILT DGSA, Manager Dangerous Goods Information

Hard at work or hardly working?

Q. We have a driver that has said that they work on the weekend, however they are refusing to tell us what hours they are working. What are the rules on this?

A. The driver should be informing their main employers as they are responsible for recording their working time. Two pieces of legislation cover this, firstly EU 561/2006, Article 4 (e) states, ‘other work’ means all activities which are defined as working time in Article 3(a) of Directive 2002/15/EC except ‘driving’, including any work for the same or another employer, within or outside of the transport sector. The second is The Road Transport (Working Time) Regulations 2005 regulation 11 (b) ‘include time worked for another employer in the calculation of the mobile worker’s working time’.

Ratchet job

Q. I have recently been told by one of our drivers that we need to use to ratchet straps to secure an IBC on a vehicle. Is this correct?

A. The Guide to Securing loads on HGVs and goods vehicles - 6. How to carry different types of load in HGVs and goods vehicles - Guidance - GOV.UK (www.gov.uk) explains how IBCs should be secured. It states that either two webbing ratchet straps should pass through the skeleton frame or another lashing method such as a bungee tarpaulin system that distributes the securing force across the top of the IBCs.
