Penalty save

Q) We are a Northern Ireland operator, and one of our drivers has received penalty points on their driving licence: do we have to report this to anyone?

A) Under The Goods Vehicles (Licensing of Operators) Act (Northern Ireland) 2010, you are required to report a conviction of a road transport offence in the UK, or corresponding offence outside the UK to the Head of Transport Regulation Unit (Head of TRU) on behalf of the Department for Infrastructure.

Q) Is there any requirement in the O-licence to keep vehicles within the designated parking areas at operating centres? i.e. if they can fit three vehicles in a space dedicated for two vehicles or park a vehicle in a way that would obstruct access to sections of the yard, but not the operating centre itself.

A) As all of the vehicles are being parked within the grounds of the operating centre, there would be no breach of the operator licence unless there were specific conditions or undertakings attached to the licence that required vehicles to be parked in specific areas or bays.

However, consideration should always be given for sufficient space to enable drivers to carry out their daily walk around checks safely and effectively.

If there are no conditions or undertakings attached to the licence of such nature, where the vehicles are parked would come down to any policies or risk assessments. Certainly, if vehicles are parked along driving routes within the yard it would be reasonable to suggest a thorough, robust risk assessment is completed and regularly reviewed.
