Q: We have a training app that is accessible through a computer, laptop or a phone. Some of our drivers are completing the training at home over the weekends, is this classed as an interruption to their daily or weekly rest?

A: If the driver is under no obligation or instruction to complete this training outside of work with provisions in place to do this during a working day, and is choosing to do this training of his or her own volition, then this would be considered as part of their rest and would be recorded as such.

If there is a concern or fear of repercussion or consequence of failing to do this training, then our interpretation would be that they are under instruction and as such be classed as working time.

Lorry seems to be the hardest word

Q: One of our drivers was involved in an incident on the road involving street furniture. On return to site, they were tested as part of our company drug and alcohol procedure, which is instigated after any incident occurs. The result came back that they were under the influence, and after an investigation and disciplinary procedure were dismissed. Should we notify anyone of this?

A: Unfortunately, in this case, reporting this to any potential employers may be considered to be discrimination against this person, even if you believe that you may be protecting a future employer or members of the public. While the driver may have committed an offence by driving under the influence, they have not been caught by an enforcement officer and convicted of this.

For those with a vocational licence, if the company is able to provide concrete evidence to the Office of the Traffic Commissioner that the driver has been taking prohibited substances and the transport manager is prepared to attend a driver conduct hearing, then this would be looked into in more detail and the transport manager may be required to give evidence.
